1. Acceptance of Terms

By downloading, installing, or using the Gout Tracker mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legal agreement between you and LeMaNg, LLC ("we," "our," or "us"), the developer and operator of the App.

2. Description of Service

Gout Tracker is a mobile health application designed to help users:

• Track gout attacks and symptoms
• Monitor food intake through photo documentation
• Identify potential triggers
• View personal health trends and analytics
• Set medication and health reminders
• Export data for healthcare provider consultations

3. Medical Disclaimer

3.1 Not Medical Advice

The App is designed for informational and tracking purposes only. It does not provide medical advice, diagnosis, or treatment recommendations. Any information provided by the App should not replace professional medical consultation, diagnosis, or treatment.

3.2 Emergency Situations

The App is not designed for emergency use. In case of medical emergency, contact emergency services immediately (911 in the US). Do not rely on the App for urgent medical situations.

3.3 Healthcare Provider Consultation

Always consult with your healthcare provider before making changes to your treatment plan, medication, or lifestyle based on information from the App.

4. User Eligibility and Account

4.1 Age Requirements

You must be at least 13 years old to use the App. If you are under 18, you must have parental or guardian consent to use the App.

4.2 Accurate Information

You agree to provide accurate, current, and complete information when using the App. You are responsible for maintaining the accuracy of your personal health data.

4.3 Account Security

You are responsible for maintaining the security of your device and any data stored on it. Use device security features like passcodes and biometric locks to protect your health information.

5. Data and Privacy

5.1 Local Storage

Your health data is stored locally on your device and is not transmitted to our servers. You maintain complete control over your personal health information.

5.2 Data Ownership

You own all the data you input into the App. We do not claim ownership of your personal health information.

5.3 Privacy Policy

Our collection and use of any information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

6. Acceptable Use

6.1 Permitted Use

You may use the App for personal, non-commercial purposes to track your gout-related health information and share data with your healthcare providers.

6.2 Prohibited Uses

You agree not to:

• Use the App for any illegal or unauthorized purpose
• Attempt to reverse engineer, modify, or create derivative works of the App
• Use the App to store or transmit harmful, offensive, or illegal content
• Interfere with or disrupt the App's functionality
• Use the App to provide medical advice to others
• Share the App with others for commercial purposes

7. Intellectual Property

7.1 App Ownership

The App, including its source code, design, features, and functionality, is owned by LeMaNg, LLC and is protected by copyright, trademark, and other intellectual property laws.

7.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to download and use the App on your personal devices for your personal use, subject to these Terms.

7.3 Trademark

Gout Tracker and related marks are trademarks of LeMaNg, LLC. You may not use our trademarks without our prior written consent.

8. App Updates and Changes

8.1 Updates

We may provide updates, modifications, or enhancements to the App at our discretion. You agree to accept such updates, which may require you to update your version of the App.

8.2 Feature Changes

We reserve the right to modify, suspend, or discontinue any feature of the App at any time. We will make reasonable efforts to notify users of significant changes.

9. Limitation of Liability

9.1 Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

9.2 Limitation of Damages

To the maximum extent permitted by law, LeMaNg, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses.

9.3 Maximum Liability

Our total liability to you for all claims arising from or related to the App shall not exceed the amount you paid for the App (if any) in the twelve months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless LeMaNg, LLC from and against any claims, damages, losses, costs, and expenses arising from your use of the App or violation of these Terms.

11. Termination

11.1 Termination by You

You may stop using the App at any time by uninstalling it from your device. Uninstalling the App will remove all locally stored data.

11.2 Termination by Us

We may restrict or terminate your access to the App if you violate these Terms, though since the App operates locally, this primarily applies to future updates or support.

11.3 Effect of Termination

Upon termination, your license to use the App ends, but any data stored locally on your device remains under your control.

12. Governing Law and Disputes

12.1 Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

12.2 Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

12.3 Class Action Waiver

You agree to resolve disputes individually and waive any right to participate in class action lawsuits or class-wide arbitration.

13. International Use

The App is intended for use in the United States. If you access the App from other countries, you are responsible for compliance with local laws and regulations.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes through:

• In-app notifications
• Updates to this page with revised "Last Updated" date
• Email notification (if we have your email address)

Your continued use of the App after changes become effective constitutes acceptance of the revised Terms.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and LeMaNg, LLC regarding your use of the App.
